Acceptance of Terms
Welcome to ClearScan. By accessing our website, booking services, or receiving diagnostic imaging, you agree to be bound by these Terms and Conditions. These Terms constitute a legal agreement between you (“User” or “Patient”) and ClearScan. ClearScan reserves the right to update or modify these Terms at any time.
Eligibility and Account Registration
To use ClearScan services, you must be of legal age and capable of entering into a binding agreement. Certain services may require a valid health card or insurance information. Users are responsible for providing accurate and up-to-date information when creating accounts or booking appointments. You are also responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Any unauthorized use should be reported to ClearScan immediately.
Booking, Payment, and Fees
All appointments and diagnostic services must be booked through ClearScan's website or authorized channels. Payment for services is required as specified during the booking process. ClearScan accepts payment via approved methods and reserves the right to suspend or cancel appointments in the event of non-payment. Refunds, rescheduling, or cancellations are governed by ClearScan's cancellation policy, which is communicated at the time of booking. Users are responsible for reviewing fees and payment terms prior to using the services.
Use of Services and Prohibited Conduct
Users must utilize ClearScan services solely for lawful purposes related to medical imaging and diagnostic care. Prohibited activities include, but are not limited to: submitting false or misleading information, accessing services on behalf of others without authorization, attempting to interfere with or disrupt the website or services, uploading harmful software or malware, and infringing on the intellectual property or privacy rights of ClearScan or third parties. Any violation may result in immediate suspension or termination of access, without prior notice, and may subject the User to legal action.
Medical Disclaimer
ClearScan provides diagnostic imaging services for informational and healthcare support purposes only. The results of scans and other diagnostic information do not constitute medical advice, diagnosis, or treatment. Users should consult their primary healthcare provider for interpretation of results and medical decisions. ClearScan does not provide emergency services; in case of a medical emergency, call 911. Users must seek immediate professional assistance.
Intellectual Property
All content on ClearScan’s website and platforms, including text, images, graphics, logos, and software, is owned by ClearScan or its licensors and protected by Canadian and international intellectual property laws. Users may not copy, distribute, modify, or create derivative works from this content without ClearScan’s express written permission. Unauthorized use of ClearScan branding, logos, or other materials is strictly prohibited.
Third-Party Services and Links
ClearScan may provide links to third-party websites or integrate third-party services for scheduling, payment, or analytics purposes. ClearScan does not control these third-party sites, and we are not responsible for their content, practices, or policies. Users accessing external sites do so at their own risk and should review the applicable terms and privacy policies of those third parties.
Limitation of Liability
To the fullest extent permitted by law, ClearScan shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use our services, including scan results, website content, or third-party integrations. Services are provided on an “as-is” basis, and ClearScan does not guarantee outcomes or the accuracy of results. Certain provincial laws may limit these disclaimers.
Termination and Suspension of Services
ClearScan reserves the right to suspend or terminate a User’s access to our services at any time, with or without notice, if:
- The User violates these Terms;
- There is suspected fraudulent or unauthorized activity.
- Required legal or regulatory conditions are not met.
Termination or suspension doesn’t free the User from their duties that existed before, such as paying or compensating for damages.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the province in which the service is provided, as well as the federal laws of Canada applicable thereto. Any disputes arising from the use of ClearScan services or the interpretation of these Terms shall be resolved in the courts of the province where the services were rendered, unless otherwise agreed in writing. Users and ClearScan agree to attempt to resolve disputes peacefully before initiating legal proceedings.
Changes to Terms
ClearScan may update these Terms periodically to reflect changes in services, legal requirements, or business practices.
Updated Terms will be posted on the ClearScan website with a “Last Updated” date. Continued use of ClearScan’s website or services after such updates constitutes acceptance of the revised Terms.
Severability and Miscellaneous
If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.
These Terms constitute the entire agreement between the User and ClearScan regarding the use of our services and replace any prior agreements or understandings, whether written or oral. Assignment or transfer of rights under these Terms by Users requires ClearScan’s prior written consent.
